Read Ch 15-16 (129-143) and answer the following questions/statements:

·   Describe some of the powers of the judiciary.  In what ways does the Constitution limit the power of the U.S. Supreme Court?

The Constitution gave the judiciary branch the power to deem a law unconstitutional, judge cases between a state and a citizen, and decide whether or not to hear a case on appeal.

The Constitution limits the U.S. Supreme Court's power by allowing them to be impeached, having multiple justices that keep each other in check, requiring a majority vote, and giving them no excuse to be persuaded one way or another by fear of loosing their jobs, or not being reelected. Since the president nominates them they aren't elected.

The rights the Constitution gave the judicial branch are basically to judge cases, and state laws as being unconstitutional.

The limits placed on this branch by the Constitution are as follows; multiple judges in the branch to check rulings and they can be impeached for committing a serious crime such as treason or bribery.

I agree with Lucy. Requiring a majority rule really limits power. This makes sure no one judge can completely manipulate the system. More than half of the justices must agree.

I agree with Devyn that if a judge say takes a bribe from a person to vote a certain way, then that person can be tried for treason and bribery and may even be tried in their own courtroom.

The powers of the judiciary are the power to hear cases and make decisions, the power to deem a law as unconstitutional, and the power to decide whether to hear a case on appeal.

The Constitution limits the power of the U.S. Supreme Court by requiring a majority vote to make a decision, making it so they can be removed from office, or impeached, having multiple judges, and making it so they have no reason to worry about the influence of political pressures because they are appointed, not elected.

I agree with Claire. The Supreme Court being limited by not only requiring a majority vote, but being able to be impeached helps retain the safe sense of knowing there is no funny business going on.

I agree with Devyn. The Supreme court is limited because of the multiple judges. Different people have different opinions and in the Supreme court they have to have majority rules.

I agree with Lucy. Being nominated really gives the judges the freedom to say what they want and do what they think is right. If they believe in something that isn't very popular they can say that without having the fear of losing their job.

Oops I accidentally submitted that. Here is the complete version:

As much as I agree with Claire, I also have to respectfully disagree on limits of power. I do not understand how being appointed limits their power, instead of elected. Yes I understand that it does not influence the judges, making them independent of politics. Does that really make the judges power limited?

The Constitution gives many powers to the Judiciary including:
• Independent of politics
• Should keep their positions in good behavior, but can be impeached
• Supreme Court has two types of jurisdiction – original and appellate. Original jurisdiction means that the matter has to do with the constitution and must go directly to the Supreme Court. Appellate jurisdiction means that the decision is appealed from a lower court and goes to the Supreme Court if they want to hear the case if they want
• Overrule state laws that violate the constitution

There are also limits placed on Judiciary in the Constitution
• Can be impeached and convicted
• Cannot make law, but have to rule on existing law

I agree with Sarah that it was best to have the president nominate the judges for life so they would be separate from politics.

I agree with Lucy. Needing a majority rule really limits power. This makes sure no one person can completely take over the branch.

Some of the powers of the judiciary are 1) they can decide if they want to hear cases and not have worry about political influence. The judges cannot be removed from office unless they are impeached.

The US Supreme Court is limited because they can be impeached for wrongdoing such as treason, bribery, and other high crimes.

The constitution gave the judicial branch the power to be judges on a federal level. They are somewhat separate from the other branches, and they are appointed rather than elected, so that they can focus on their judgement and choices, and not on the public's pressures and opinions. It also gives the judges the power to keep their jobs for life unless they are impeached.

The way the constitution limits the justices' power is by making it possible for the House of Representatives to impeach the justices, and for the Senate to try and convict them. The only way this can happen is is a justice is accused of "Treason, bribery, or other high Crimes and Misdemeanors." Only one man, Samuel Chase, has ever been impeached, but he was acquitted by the senate.

The members of the judiciary branch are appointed so that they were excluded from the pressures of politics. The Supreme Court settles disputes between states and is able to declare laws, passed by Congress, unconstitutional. A recent case of this was American Broadcasting Cos., Inc., v. Aereo, Inc. Aereo transmitted television shows to their customers using the air waves. The company followed everything Congress told them to do in order for their company to be considered constitutional. This case eventually reached Supreme Court. The Supreme Court declared the way Aereo transmitted their signals unconstitutional. This is what caused the company to shut down. Decisions are made using a majority vote. The justices of the Supreme Court can keep their job for life as long as they maintain good behavior, meaning they don't commit a crime. The court cannot declare something unconstitutional if it has been written into the constitution.

The judicial branch's function is to interpret laws, and it consists of the Supreme Court. Some of the powers the Supreme Court was given by the Framers were that they could overrule state laws that they declared unconstitutional. They have the power to hear cases and make decisions as well. The judicial branch is limited by checks and balances. For example, Congress can impeach judges, and the President appoints Supreme Court judges.

The US Judicial Branch interprets the law. The President can either sign the law definition or veto it and send it to Congress. This is a power check on the Judicial Branch, so they can't just make a law mean something completely other than what it was supposed to mean.
